The rules for using FarmMarket (farmers.mafihub.co.za)

1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the FarmMarket website at farmers.mafihub.co.za and any related services (the "Platform"), operated by Mafikeng digital innovation hub ("FarmMarket", "we", "us", "our"). By creating an account, browsing listings, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
FarmMarket is a marketplace that connects agricultural buyers and sellers ('Farmers' or 'Sellers'). We provide the technology that lets Sellers list products and lets Buyers discover and contact Sellers directly. We are not a party to, and do not control, the actual sale, purchase, delivery, or payment of any product listed on the Platform.
2. Eligibility and Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
You must provide accurate, current, and complete information when registering, and keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
One account per person or business, unless we agree otherwise in writing.
We may suspend or terminate accounts that provide false information or violate these Terms.
3. Buyer Accounts
Buyer accounts are free of charge. As a Buyer, you may browse listings, contact Sellers via our in-platform messenger, and request Seller contact details, all at no cost to you. FarmMarket does not charge Buyers any listing fees, commissions, or transaction fees.
4. Seller Accounts and Subscriptions
Sellers access the Platform through a paid subscription plan. Current plans (Starter and Enterprise) and their features and pricing are set out on our pricing page and may be updated from time to time; the version displayed at checkout applies to your subscription.
Subscription fees are billed in advance on a recurring monthly basis (or as otherwise stated at sign-up), in South African Rand (ZAR) unless stated otherwise.
Fees are exclusive of VAT unless stated otherwise, and VAT will be added where applicable by law.
Subscriptions renew automatically each billing period until cancelled by the Seller.
You may cancel your subscription at any time through your seller dashboard; cancellation takes effect at the end of the current billing period, and no partial refunds are given for the unused portion of a period unless required by law.
We may change subscription pricing with at least 30 days' notice to affected Sellers before the change takes effect.
Failure to pay subscription fees when due may result in suspension or downgrade of your seller account, including removal of listings above a lower tier's limit.
5. Listings and Content
Sellers are solely responsible for the accuracy, legality, and quality of the products, descriptions, prices, images, and other content they post ('Listings'). By posting a Listing, you confirm that you have the right to sell the product described, that the Listing is accurate, and that it complies with all applicable laws (including agricultural, food safety, animal welfare, and consumer protection laws).
We may remove or edit any Listing that we reasonably believe violates these Terms, is misleading, unlawful, or otherwise inappropriate.
You grant FarmMarket a non-exclusive, royalty-free licence to display, reproduce, and distribute your Listing content on the Platform and in related marketing.
Prohibited Listings include, without limitation: illegal goods, counterfeit or stolen goods, hazardous substances not properly licensed, and anything that infringes a third party's rights.
6. Nature of the Platform — No Party to Transactions
FarmMarket provides a venue for Buyers and Sellers to connect and communicate. Once contact is made (whether via our messenger or shared contact details), any negotiation, agreement, payment, delivery, and dispute relating to the sale of goods occurs directly between the Buyer and Seller. FarmMarket:
is not a party to any sale agreement between a Buyer and a Seller;
does not process, hold, or guarantee any payment made between Buyers and Sellers;
does not inspect, grade, or certify the quality, safety, or legal compliance of any product listed;
does not arrange, control, or guarantee delivery, transport, or logistics for any transaction.

7. Seller Verification
We may take reasonable steps to verify Seller identity or business details before or after account approval. Verification is not a guarantee of a Seller's reliability, product quality, or conduct, and Buyers should exercise their own judgment before transacting.
8. Acceptable Use
You agree not to:
use the Platform for any unlawful purpose or in violation of these Terms;
post false, misleading, defamatory, or infringing content;
harvest or scrape data from the Platform without our written consent;
circumvent, disable, or interfere with the security or functionality of the Platform;
impersonate any person or entity, or misrepresent your affiliation;
use the Platform to send unsolicited marketing or spam to other users.
9. Intellectual Property
The FarmMarket name, logo, website design, and underlying software are the property of FarmMarket or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any such rights to you, other than the limited right to use the Platform as permitted here.
10. Disclaimers
The Platform is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, FarmMarket disclaims all warranties, express or implied, regarding the Platform, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, FarmMarket and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Platform or any transaction between Buyers and Sellers. Our total aggregate liability to you for any claim arising out of these Terms is limited to the amount you paid to FarmMarket (if any) in the 3 months preceding the claim.
Nothing in these Terms limits liability that cannot be limited under the Consumer Protection Act 68 of 2008 or other applicable South African law.
12. Indemnity
You agree to indemnify and hold FarmMarket harmless from any claims, losses, or damages, including reasonable legal fees, arising from your breach of these Terms, your Listings, or any transaction you enter into with another user.
13. Suspension and Termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or harmful conduct, or if required by law. You may close your account at any time by contacting us or via your account settings.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page with a new 'Last updated' date, and material changes will be notified to registered users by email or an in-platform notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the South African courts, without prejudice to any right you may have to refer a consumer dispute to the National Consumer Commission or another applicable ombud or regulator.
